{"id":223036,"date":"2025-02-06T19:06:08","date_gmt":"2025-02-06T19:06:08","guid":{"rendered":"https:\/\/www.musicbusinessworldwide.com\/?p=223036"},"modified":"2025-02-06T19:06:08","modified_gmt":"2025-02-06T19:06:08","slug":"uk-court-rejects-sonys-bid-to-throw-out-case-over-ownership-of-jimi-hendrixs-music","status":"publish","type":"post","link":"https:\/\/www.musicbusinessworldwide.com\/uk-court-rejects-sonys-bid-to-throw-out-case-over-ownership-of-jimi-hendrixs-music\/","title":{"rendered":"UK court rejects Sony\u2019s bid to throw out case over ownership of Jimi Hendrix\u2019s music"},"content":{"rendered":"<p>Sony Music Entertainment is one step closer to facing a full trial over the ownership of music recorded by the Jimi Hendrix Experience.<\/p>\n<p>The music company that distributes the recordings of the legendary <strong>Jimi Hendrix<\/strong>-led band has lost an appeal in front of a UK court, in which it sought to throw out a lawsuit brought by the estates of <strong>Mitch Mitchell<\/strong> and <strong>Noel Redding<\/strong>, the other two members of the Jimi Hendrix Experience.<\/p>\n<p>Hendrix, Mitchell, and Redding formed The Jimi Hendrix Experience in 1966, with Mitchell on drums and Redding on bass guitar. The band broke up in 1969, one year before Hendrix died of an accidental drug overdose. Most of the music associated with Jimi Hendrix today comes from these three albums, including the band\u2019s classic cover of <strong>Bob Dylan<\/strong>\u2019s <em>All Along The Watchtower<\/em>.<\/p>\n<p>Hendrix, Mitchell, and Redding reportedly made an agreement in 1966 \u2013 the year the band was formed \u2013 that gave the band\u2019s then-managers, <strong>Michael Jeffery<\/strong> and <strong>Chas Chandler<\/strong>, certain rights to the sound recordings.<\/p>\n<p>Sony cited a 1973 agreement in which Mitchell and Redding agreed never to sue Hendrix&#8217;s estate or record companies distributing the music. Redding received a $100,000 payment, and Mitchell received $247,500 in exchange for dropping the lawsuits they had filed at the time over the rights to the band&#8217;s music, <a href=\"https:\/\/www.reuters.com\/world\/uk\/estates-jimi-hendrix-bassist-drummer-can-sue-sony-album-rights-court-2024-01-29\/\" target=\"_blank\" rel=\"noopener\">according to<\/a> <em>Reuters<\/em>.<\/p>\n<p><span style=\"font-weight: 400;\">      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__spu\" data-loaded=\"no\" data-name=\"300x250 Sponsor MPU #1\" data-params=\"dfp_spu1\" id=\"dfp_spu1\"><\/div>      <\/div>      <\/span><\/p>\n<p>However, the case hinges on how far those rights extend \u2013 specifically, whether they covered future technological changes, such as streaming.<\/p>\n<p>A three-judge panel of the Court of Appeal of England and Wales upheld on Thursday (February 6) an earlier decision by the High Court that there is sufficient doubt about the proper ownership of the rights to the Jimi Hendrix Experience to warrant a full trial, according to a <a href=\"https:\/\/iclg.com\/news\/22240-sony-s-jimi-hendrix-appeal-dismissed-by-london-court\" target=\"_blank\" rel=\"noopener\">report<\/a> from the Global Legal Group.<\/p>\n<p>\u201cNoel and Mitch first issued their complaint in November 2021 and after the latest delaying tactic of Sony to deny them justice the case now moves to a full trial scheduled for December 2025, over four years later,\u201d said <strong>Edward Adams<\/strong>, a director for the Mitchell and Redding heirs.<\/p>\n<p>\u201cWe retain our faith in the justice system that they and their licensors, <strong>Experience Hendrix LLC<\/strong>, will be finally held fully to account at that time.\u201d<\/p>\n<p><span style=\"font-weight: 400;\">      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__spu\" data-loaded=\"no\" data-name=\"300x250 Sponsor MPU #2\" data-params=\"dfp_spu2\" id=\"dfp_spu2\"><\/div>      <\/div>      <\/span><\/p>\n<p>Sony Music licenses Jimi Hendrix Experience recordings from Experience Hendrix, a company owned by Jimi Hendrix\u2019s heirs.<\/p>\n<p>In 2021, Mitchell and Redding\u2019s heirs asserted that they own a share of the recording rights and are owed millions in royalties, <a href=\"https:\/\/www.billboard.com\/pro\/jimi-hendrix-lawsuit-trial-uk-court-rejects-sony-appeal-bandmates\/\" target=\"_blank\" rel=\"noopener\">according to<\/a> <em>Billboard<\/em>.<\/p>\n<p>Sony and Experience Hendrix responded by filing a lawsuit against the heirs in a federal court in New York. The Mitchell and Redding estates filed their own lawsuits in the UK, and in 2023, the judge in the New York case ruled that the UK case could take precedence.<\/p>\n<p>In that case before the High Court in London, Sony sought a summary judgment tossing out the Mitchell and Redding heirs\u2019 claims. The judge rejected that motion, triggering Sony\u2019s appeal.<\/p>\n<hr \/>\n<p>In its appeal, Sony argued that under UK copyright law, the original \u201carrangements\u201d that Mitchell and Redding made are still in effect.
